If you do not agree to our user terms, you must cease access to and use of our website. This version of our user terms was updated on, and is effective on and from: 19th May 2016.

We may change our user terms without notifying you. If we change our user terms, we will post the updated user terms on our website. By continuing to access and use our website after the updated user terms have been posted on our website, you agree to our updated user terms.

If you provide personal information to us through your access to and use of our website, we manage your personal information based on our privacy policy.

4. Accessing and using our website

You may download the material on our website, provided that it is for your own non-commercial purpose and you acknowledge our interest in the IP. You must only access and use our website through www.resourcecall.com.au, or its mobile application. You must not (and must not attempt to):

  • (a) access our website, except through the interface provided by us;
  • (b) interfere with or disrupt our website, the features of our website or the servers and networks that host our website;
  • (c) use data mining, robots, screen scraping or other data gathering and extraction tools on our website;
  • (d) use, modify, copy or distribute the material on our website for a commercial purpose;
  • (e) sell, redistribute or reuse the material on our website for a commercial purpose; or
  • (f) use the material on our website to conduct the same or similar business or provide the material on our website to another person to conduct the same or similar business.

We may refer any actual (or suspected) fraudulent, abusive or illegal activity by you to relevant government agencies.

While we may provide links and pointers to other websites owned and operated by other people from our website, we are not responsible for their content or conduct. We provide these links and pointers to other websites as a convenience and, by providing these links and pointers to other websites, we are not endorsing or recommending the content of those websites or the conduct of those people.

We do not endorse or recommend any of the work Call-Out, business or employment opportunities posted on, referred to or linked to our website. We encourage you to obtain advice or make your own evaluation of the accuracy, completeness and usefulness of any opinions, advice, services, merchandise and other material posted on, referred to or linked to our website.

5. IP

The material on our website is owned by, or licensed to, us. You must not:

  • (a) use the material on our website, including our logos, business names, domain names or any other content, without our prior written consent;
  • (b) modify or copy the layout or appearance of our website or code contained in our website; or
  • (c) decompile or disassemble, reverse engineer or attempt to discover or access any source code relating to our website.

If you communicate with us, we may use, copy, post, distribute or create derivative works of the content of your communication or incorporate the content of your communication into other works in order to market and promote our business. This may include your ideas for new or improved products and services.

6. Liability

We are not liable to you for any loss, expense, damage or liability suffered or incurred by you through your access to and use of our website. In particular, we are not liable for the following:

  • (a) you are not able to access our website
  • (b) you experience a fault or disruption in accessing our website;
  • (c) there are inaccuracies, errors or mistakes in the material posted on, referred to or linked to our website;
  • (d) you act on the material posted on, referred to or linked to our website; or
  • (e) bugs, viruses, trojan horses or other harmful code or communications are transmitted to or through our website by us or another person.

If we are liable to you in negligence, contract breach or at common law, any express or implied conditions or warranties, including conditions or warranties implied by law, are excluded. If our liability is not excluded, our liability to you is limited to either (in our absolute discretion) the cost of repairing or resupplying the goods or services or paying to you the cost of repairing or resupplying the goods or services. Nothing in our user terms limits your rights under the Australian Consumer Law.

7. Issues and disputes

If you have an issue, we encourage you to contact us and we will try to resolve it in accordance with the laws of Victoria, Australia. If there is a dispute, you submit to the exclusive jurisdiction of the courts of Victoria, Australia or federal courts based in Victoria, Australia.

8. Terms

In our user terms, the following terms have the following meanings:

  • IP: copyright, trademark, patent or other intellectual property right of a person
  • Material: includes comments, messages, text, files, images, photos, video, sounds and other information
  • We, our or us: ResourceCall.com.au (AMENSK PTY LTD.: ABN 71 601 695 694)
  • Website: www.resourcecall.com.au or its mobile site or application, and any of their associated services and functionality
  • You or your: anyone who accesses and uses our website
  • User terms: the user terms posted on our website and which outline the terms upon which you may access and use our website

Member terms

1. Eligibility

To access our member services, you must become a member. Becoming a member is free. If you have a current Australian residential address and are over 16 years of age, you may apply to become a member. To become a member, you must register online using our website by providing a unique and valid e-mail address and password. We may refuse your application to become a member.

2. Application

By becoming a member, you agree to our member terms. Please read our member terms carefully before becoming a member. If you do not agree to our member terms, you must not become a member. This version of our member terms is effective on and from: 2nd March 2015.

3. Updates

We may change our member terms without notifying you. If we change our member terms, we will post the updated member terms on our website. By continuing to access and use our member services after the updated member terms have been posted on our website, you agree to our updated member terms.

4. Personal information

To become a member, you must provide your personal information to us. We manage your personal information based on our privacy policy. If you wish to access your personal information, you can do so by logging on, clicking on your account settings and then clicking on your details. If you wish to update your personal information, you can do so by updating your details under your account settings or in your Profile if this is applicable as a member.

5. Changes to our member services

We may change our member services, temporarily or permanently stop you accessing our member services or change the means by which you can access our member services without notifying you.

6. Managing your account

You are responsible for the activity that occurs on your account. You must keep your login password safe and secure. If you become aware of (or suspect) unauthorised activity on your account or that your password is no longer secure, please contact us and take steps to re-secure your account, such as changing your password. If you wish to change your password, you can do so by logging on, clicking on your account settings, then clicking on change password and following the prompts.

7. Transferring your membership

You must not transfer, sell or give your membership to another person.

8. Ending your membership

If you wish to end your membership, please contact us. If you end your membership, you are unable to further access and use our member services. If you do not log onto our website for a period of 12 consecutive months, we may end your membership without notifying you.

9. Terminating your membership

If you fail to comply with our member terms, provide misleading information, make a misrepresentation to us in connection with your membership or are abusive or offensive to us or other users or members of our website, we may temporarily or permanently terminate your membership without notifying you. If your membership is terminated, you are unable to further access and use our member services.

10. Promotions

If we offer a promotion to members, additional terms apply. In this case our promotion terms are posted on our website and form part of these terms.

11. Privacy policy

Our privacy policy specifies the personal information we collect, how we use that personal information, to who we may disclose that personal information and your rights. Our privacy policy is posted on our website and forms part of these terms.

12. Accessing and using our member services

We may retain server and backup copies of the material posted or submitted by you or through your account, even if you have altered, removed or deleted material from public display. You are responsible for the material posted or submitted by you or through your account. You must not post or submit (or allow to be posted or submitted) material through your account that:

  • (a) you do not have the right to post or submit;
  • (b) is unlawful;
  • (c) is misleading or deceptive;
  • (d) is offensive or is likely to be offensive;
  • (e) is defamatory;
  • (f) incites hatred or discrimination or denounces religious or political beliefs;
  • (g) is indecent, obscene, vulgar, pornographic, offensive or is likely to annoy or concern;
  • (h) infringes the IP of another person;
  • (i) contains viruses, data or software designed to interrupt, destroy or limit the functionality of computer software or hardware; or
  • (j) impersonates a person or misrepresents your relationship with a person.

13. Resource members

The following terms specifically apply to Resource members:

(a) Using our Profile and resource member tools

If you register as a resource, you gain access to our resource tools, including submitting a Profile and receiving and accepting or declining work Call-Outs; adding, editing and storing data in our PD Manager Solution; searching for Professional Development courses; and accessing the application and contact details for Job Posts on our Job Board and Room Hire Post on our Room Hire Board.

The material included in a work Call-Out, Job Post, Room Hire Post and Professional Development course is supplied by registered Employer members. While we strongly encourage employers to comply with our member terms, we are not responsible for their conduct, inaccuracies, errors or mistakes in material that may be misleading or deceptive in nature included in a work Call-Out , Job Post, Room Hire Post or Professional Development course. We strongly encourage you to make your own enquiries to verify the material included in the work Call-Out or Job Post with employers before you are hired or sign a contract. We are not responsible for any act or omission by you in reliance on the material included in a work Call-Out , Job Post, Room Hire Post or Professional Development course.

If you submit a Profile, you may not receive a work Call-Out and we do not guarantee that you will receive a work Call-Out just because you submit a Profile. If you submit a Profile, you may not be offered the position described in the work Call-Out. If an employer submits a work Call-Out, that employer may not have the job position described in the work Call-Out or may have already hired a person for that position, even though the position described in the work Call-Out described is posted on our website.

You must be a registered member of our website to use our PD Manager Solution and respond to a Job Post or contact a Room Hire advertiseron our site. If you respond to a Job Post by contacting the employer through the details they have provided on a Job Post we do not guarantee that you will be successfully hired for that advertised position. You may not be offered the position described in the Job Post. If an employer submits a Job Post, that employer may not have the job description described in the Job Post or may have already hired a person for that position, even though the position described in the Job Post is posted on our website.

Before the interview process, you may only contact employers through the telephone number and e-mail address specified in their account settings or Job Post. Before the interview process, employers may only contact you through the telephone number and e-mail address specified in your account settings and only when you have indicated through our site that you are “Available and interested” in a work Call-Out or you have contacted them directly through a Job Post on our website. If an employer makes contact with you outside or beyond the job hire process conducted through our website, please contact us.

You must not make uninvited contact with employers outside or beyond the work Call-Out or Job Post process conducted through our website. You must not contact (or attempt to contact) employers who interview you, but do not hire you, regardless of whether that contact (or attempted contact) occurs during or after the work Call-Out or Job Post process conducted through our website.

You are only able to respond to a work Call-Out up to the day of the advertised start date in the work Call-Out details. After the advertised work Call-Out start date the work Call-Out will be automatically closed to resource member responses. If no start date is listed in the advertised work Call-Out then the work Call-Out will be active and able to be accessed by you up to 14 days after the work Call-Out was sent. After 14 days from the sent date the work Call-Out will be automatically closed to resource member responses.

We may (in our absolute discretion) delete, withdraw or require you to amend your Profile submitted by you or other material posted by you on our website.

We do not take any responsibility for conversations, agreements, contracts, hiring negotiations or decisions made by you or the employer after you have selected “I am available and interested” in response to a work Call-Out or a Job Post.

14. Employer members

The following terms specifically apply to Employer members:

(a) Using our employer tools

If you register as an employer, you gain access to our employer tools, including searching resource profiles, shortlisting suitable resources, sending SMS work Call-Outs, searching Room Hire advertisements, searching and shortlisting PD Shop courses, contacting Room Hire advertisers, using our PD Manager solution and posting ads on our Room Hire Board, Job Board or PD Shop.

The material included in resource profiles or responses to your Job Posts are submitted by registered resource members. While we strongly encourage resource members to comply with our member terms, we are not responsible for their conduct, inaccuracies, errors or mistakes in the profiles or material that may be misleading or deceptive in nature included in the profiles. We strongly encourage you to make your own enquiries to verify the material in profiles and responses to your Job Posts with resources before you hire the resource member. We are not responsible for any act or omission by you in reliance on the material included in a resource’s profile.

If a resource responds to a work Call-Out or Job Post, that resource may also apply to other work Call-Outs and Job Posts. If you hire a resource for the work/ position described in your work Call-Out or Job Post brief, that resource may not be suitable or available for the work/position. You may not receive any responses for the position described in your work Call-Out or Job Post. Your work Call-Out or Job Post may not result in you hiring a resource for the work/ position described in that work Call-Out or Job Post.

You are only able to contact a resource once they have responded with “I am available and interested” to your work Call-Out or have contacted you directly in response to your advertised Job Post. You may only contact resource members through the telephone number and e-mail address specified in their account settings. You must not include further contact information in your work Call-Out or Job Post. Resource members may only contact you, if they have received a work Call-Out and have selected “I am available and interested” in the site or have contacted you through contact details supplied by you in your Job Post. Resources may only contact you through the telephone number and e-mail address specified in your account settings or Job Post. If a resource member makes contact with you outside or beyond this process conducted through our website, please contact us.

The material included in Room Hire, PD Shop Advertisements and the PD Manager Solution is submitted by registered employer members. While we strongly encourage registered employer or resource members to comply with our member terms, we are not responsible for their conduct, inaccuracies, error or mistakes in the advertisements or material that may be misleading or deceptive in nature in the advertisements or added material in our PD Manager Solution. We strongly encourage you to make your own enquiries to verify material in room hire advertisements, PD Shop advertisements and the PD Manager Solution. We are not responsible for any act or omission by you in reliance on the material included in room hire advertisements, PD Shop advertisements and the PD Manager Solution.

You must not make uninvited contact with resource members or room hire advertisers outside or beyond the work Call-Out, Job Post or Room Hire Board processes conducted through our website. You must not contact (or attempt to contact) resource members who are interviewed by you, but who you do not hire, regardless of whether that contact (or attempted contact) occurs during or after the work Call-Out or Job Post process conducted through our website.

We may (in our absolute discretion) delete, withdraw, suspend or require you to amend your work Call-Out, Job Post, Room Hire or Professional development course advertisement or other material posted by you on our website.

(b) Sending a work Call-Out

You must ensure that:

  • you have purchased a valid SMS Call-Out Credit Pack through our website to be able to send SMS work Call-Out.
  • your work Call-Out complies with relevant Australian laws, including consumer affairs and fair trading, anti-discrimination and equal opportunity and privacy laws;
  • the material entered into a data entry field relates directly to that field; and
  • your work Call-Out is for a valid position.

If you include branding in your work Call-Out, you must only use branding owned by, or licensed to, you

You must not alter the appearance, structure or form of the contact information in your account settings or include contact information in your work Call-Out. You must not request contact information of resources in your work Call-Out or at any stage of the work Call-Out process conducted through our website.

Please ensure you populate your work Call-Out, including selection of appropriate course, qualification and location information. Your selection directly affects your search results.

Your work Call-Out will be sent as an SMS link to your work Call-Out to resource members, as selected by you, once you have purchased an SMS work Call-Out Credit Pack.

You may contact a total maximum of 30 resources - trainers and/or VET workers - from our database in one 24 hour period. If you require an exception to this rule, please contact us through our Contact Us section on our website to discuss further.

(c) Managing a work Call-Out

Once a work Call-Out has been sent to selected resources, responses will automatically be recorded in the Active Call-Out section of the Call-Out menu within your Account. We will also send you an email when a response is received from resources.

If a resource member responds with “I am available and interested” in our system, we will release their contact details to you and you are able to finalise the agreement outside of our site process. We share no responsibility for conditions, agreements, discussion and contracts entered into after a resource member has indicated that they are “available and interested” in your work Call-Out. Contact details for candidates who have indicated they are “Available and Interested” are visible for 30 days from the Call-Out start date (Trainers) or sent date (Skilled Workers).

If a resource member responds with “Unfortunately I am not available at this time”, you will be advised both within the Active Call-Out section of the Call-Out menu within your Account and via email. We will not release contact details for any resource who responds in this manner.

A work Call-Out is valid and active from the date the work Call-Out is sent to the start date of work/ position specified in the work Call-Out.

Registered resource members are only able to respond to a work Call-Out up to the day of the advertised start date in the work Call-Out details. After the advertised work Call-Out start date the work Call-Out will be automatically closed to resource member responses. You will be able to view the contact details of resource members who respond with “I am available and interested” to your Call-Out up to 30 days from the Call-Out start date (Trainers) or sent date (Skilled Workers). After this time contact details will be hidden.

If no start date is listed in the advertised work Call-Out then the work Call-Out will be active and able to be accessed by resource members up to 14 days after the date that the work Call-Out was sent. After 14 days from the sent date the work Call-Out will be automatically closed to resource member responses. You will be able to view the contact details of resource members who respond with “I am interested and available” up to 30 days after the date that your Call-Out was sent. After this time contact details will be hidden.

(d) Paying our fees for work Call-Outs

To send a work Call-Out, you agree to pay the fee associated with the SMS work Call-Out Credit Pack that you select within our site and at the payment process. The fees associated with member services are in Australian dollars and exclusive of GST. Prices may change at any time at our discretion.

To use the work Call-Out services available to employers you must:

  • Use a Credit card: Enter and maintain a valid credit card with an expiry date no earlier than 1 month after the date on which you click on pay-&-submit for an SMS work Call-Out Credit Pack.

We charge the fee associated with the member services you use to your credit card at the time (or shortly after the time) they are used. You are able to send an SMS Call-Out as soon as your payment has been processed. Charges are per each individual SMS message.

Available SMS Credit is tracked in your Account settings and can be viewed at any stage. Updated available SMS Credit is also issued to you using the e-mail specified in your account settings. You cannot use our services if you do not purchase an SMS work Call-Out Credit Pack.

If we terminate your membership, you are still liable to pay us any amounts due and payable at the time of the termination, including the late payment fee which continues to accrue.

(e) Posting Job Posts

You must ensure that:

  • your job post complies with relevant Australian laws, including consumer affairs and fair trading, anti-discrimination and equal opportunity and privacy laws;
  • the material entered into a data entry field relates directly to that field
  • your job post is for a valid job; and
  • your job post does not contain advertising content for services, courses or business opportunities.

If you include branding in your job post, you must only use branding owned by, or licensed to, you. If you include an external link in your job post, you must only use a link that takes the job searcher directly to an application for or job hire process specific to your job post.

You must not alter the appearance, structure or form of the contact information in your account settings or include contact information in the "Job Title", "Job Summary" or "Job Description" section of your Job Post. You must not request contact information of job searchers in your job post or at any stage of the job hire process conducted through our website.

Please ensure you populate your job post, including selection of appropriate occupation tags and location as permitted on our website. Your selection of occupation tags and location directly affects the search results your job post appears in.

Except as stated otherwise in these member terms, we ensure your Job Post is included in search results and permit job searchers to submit applications for 90 days after your job is posted on our website. You Job Post will expire 90 days after it is posted on our website.

(f) Managing Job Posts

You can post or close a job post at any stage by clicking on the menu options provided in your Job Post section of your registered account.

You may post as may jobs as you like on our Job Board.

You may re-post a previously expired Job Post on our website.

You are responsible for managing the contact from applicants who are registered members of our website and contact you through the contact details you provide on our website in your job post.

We are not responsible for the hiring decisions you make or contracts you enter into as a result of a Job Post on our site.

We may close or remove any job posts that we deem to have breached our Terms & Conditions. We will always notify you if this occurs.

(g) Paying our fees for Job Posts

Currently it is free to post a job on our website. We reserve the right to change this and apply a fee for service at any time.

If you post a job post, you agree to pay the fee associated with that job post at the time you click on pay-&-submit. If you use any other member services available to job advertisers, you agree to pay the fee associated with those member services at the time you use those member services. The fees associated with member services are in Australian dollars and exclusive of GST.

To use the member services available to job advertisers, you must use a:
Credit card: Enter and maintain a valid credit card with an expiry date no earlier than 1 month after the date on which you click on pay-&-submit for a job post or use any other member services available to job advertisers.

(h) Posting Room Hire Advertisements

You must ensure that:

  • your room hire advertisement complies with relevant Australian laws, including consumer affairs and fair trading, anti-discrimination and equal opportunity and privacy laws;
  • the material entered into a data entry field relates directly to that field
  • your advertisement is for a valid room available for hire
  • your advertisement is for one room for hire only per ad; and
  • your advertisement does not contain advertising content for services, courses or business opportunities.

If you include branding in your job post, you must only use branding owned by, or licensed to, you. If you include an external link in your advertisement, you must only use a link that takes the searcher directly to a site or application process specific to your room hire advertisement.

You must not alter the appearance, structure or form of the contact information in your account settings. You must not include contact information in any other section of your room hire advertisement other than the section labelled “Contact Information”.

Except as stated otherwise in these member terms, we ensure your Room Hire advertisement is included in search results and permit room hire searchers to contact you directly once they have registered on our site. Your Job Post will expire either 90, 180 or 365 days after you purchased the advertisement space through our website depending on which room hire advertisement space you purchased. We will send you a reminder that your advertisement is due to expire two weeks before the actual expiry date.

(i) Managing Room Hire Advertisements

You may only advertise one room for hire per the paid advertising space. If you advertise more than one room in a single advertising space we reserve the right to close and delete that advertisement at any time. We will not refund your paid advertising fees if you breach this condition.

You can post or close a room hire advertisement at any stage by clicking on the menu options provided in the Room Hire section of your registered account.

You may post as many room hire advertisements as you like on our Room Hire Board provided you have paid for each advertisement and each advertisement is only for one room available for hire.

You may re-post a previously expired room hire advertisement on our website provided you have paid for a new advertisement.

Your room hire advertisement is valid for the period of time you purchased on our site. This may be either 90 days, 180 days or 365 days depending on the advertising period you purchased. These advertising periods may be stated as 3 months (90 days), 6 months (180 days) or 12 months (365 days) on our site.

You are responsible for managing the contact from searchers who contact you through the contact details you provide on our website in your advertisement.

We are not responsible for the hiring decisions you make or contracts you enter into as a result of a room hire advertisement on our site.

We may close or remove any room hire advertisements that we deem to have breached our Terms & Conditions. We will always notify you if this occurs.

(j) Paying our fees for room hire advertisements

To post a room hire advertisement, you agree to pay the fee associated with the room hire advertising cost that you select within our site and at the payment process. The fees associated with member services are in Australian dollars and exclusive of GST. Prices may change at any time at our discretion.

To use the Room Hire Board services available to employers you must:

  • Use a Credit card: Enter and maintain a valid credit card with an expiry date no earlier than 1 month after the date on which you click on pay-&-submit for an SMS work Call-Out Credit Pack.

We charge the fee associated with the member services you use to your credit card at the time (or shortly after the time) they are used. You are able to post a room hire advertisement as soon as your payment has been processed. Charges are per each individual room hire advertisement.

If we terminate your membership, you are still liable to pay us any amounts due and payable at the time of the termination, including the late payment fee which continues to accrue.

(k)Posting Professional Development Course Advertisements

You must ensure that:

  • your professional development course advertisement post complies with relevant Australian laws, including consumer affairs and fair trading, anti-discrimination and equal opportunity and privacy laws;
  • the material entered into a data entry field relates directly to that field
  • your post is for a valid professional development course; and
  • your post does not contain advertising content for services, non professional development courses or business opportunities.

If you include branding in your post, you must only use branding owned by, or licensed to, you. If you include an external link in your post, you must only use a link that takes the searcher directly to an information and registration process specific to your professional course advertisement post.

You must not alter the appearance, structure or form of the contact information in your account settings. Please ensure you populate your professional development course advertisement post, including selection of appropriate type, category and location as permitted on our website. Your selection of type, category and location directly affects the search results your professional development course advertisement post appears in.

Except as stated otherwise in these member terms, we ensure your professional development course advertisement is included in search results and permit searchers to click on the link to your site until the day after the start date of listed in your post. Your Post will expire the day after your advertised start date of the professional development course on our website.

(l) Managing Professional Development Course Advertisements

You can post or pause a job post at any stage by clicking on the menu options provided in the PD Shop section of your registered account.

You may post as may professional development course advertisements as you like on our PD Shop.

You may re-post and update a previously expired professional development course advertisement on our website.

You are responsible for managing the contact from applicants who contact you through the contact details you provide on our website in your post.

We are not responsible for the decisions you make or contracts you enter into as a result of a professional development course advertisement post on our site.

We may close or remove any professional development course advertisement posts that we deem to have breached our Terms & Conditions. We will always notify you if this occurs.

(m) Paying our fees for Professional Development Course Advertisements

Currently it is free to post a professional development course advertisement on our website. We reserve the right to change this and apply a fee for service at any time.

If you post a professional development course advertisement post, you agree to pay the fee associated with that post at the time you click on pay-&-submit. If you use any other member services available to registered member advertisers, you agree to pay the fee associated with those member services at the time you use those member services. The fees associated with member services are in Australian dollars and exclusive of GST.

To use the member services available to advertisers on our site, you must use a:
Credit card: Enter and maintain a valid credit card with an expiry date no earlier than 1 month after the date on which you click on pay-&-submit for a post or use any other member services available to advertisers.

(n) Using our PD Manager solution

If you are a Resource member:

  • You must register you use this service.
  • The service is free for you to use
  • You may use our PD Log template to record and store information from our PD Shop, your linked Employer members or information that you enter manually.
  • You may link with Employer members and share the contents of your PD Log. Sharing includes allowing them to suggest or add courses to your PD Log and to update the status of PD courses in your PD Log.
  • You can choose at any time to link (connect through our site) or unlink (disconnect through our site) with an Employer member account.
  • Any information you add to our site is bound by our current Terms & Conditions and Privacy Policy.

If you are an Employer member:

  • You must register to use this service.
  • We offer a free 60 day trial and after this time you must purchase one of our subscription packages to maintain the data and records you have added to our system. If you do not purchase a subscription package at the end of the 60 day free trial we will close your PD Manager solution subscription and all data will be deleted from our system. We cannot restore this information for you after the expiry date of your trial.
  • You must purchase and ensure you have one of our subscription packages to use and maintain your data in our site and to access all the available features of the PD Manager solution at all times. If you do not renew your subscription, and the expiry date is passed, all data will be deleted from our system. We cannot restore this information for you after the expiry date.
  • You may open a new PD Manager Solution subscription at any time.
  • You may use our PD Manager Solution to invite staff members to register as Resource members and use our PD Log template to record and store information from our PD Shop or any information that you have added manually to our account features.
  • When your invitation is accepted by our Resource member you will be able to suggest or add courses to their PD Log and to update the status of PD courses in their PD Log. You will not be able to access any other part of their PD Log record but you will be able to view information such as their qualifications and currency records if they have been added.
  • You may link (connect through our site) or unlink (disconnect through our site) with invited Resource members at any stage on our site and we will manage this process for you.
  • You may connect with up to 40 Resource members on our site using our standard subscription package. If you have more than 40 Resource members and you wish to use our PD Manager solution, please contact us and we will negotiate separate Terms and Conditions for use.
  • Any information you add to our site is bound by our current Terms & Conditions and Privacy Policy.

(o) Paying our fees for PD Manager Solution

To use our PD Manager Solution, you agree to pay the fee associated with the subscription package that you select within our site and at the payment process. The fees associated with member services are in Australian dollars and exclusive of GST. Prices may change at any time at our discretion.

To use the PD Manager Solution services available to Employers you must:

Use a Credit card: Enter and maintain a valid credit card with an expiry date no earlier than 1 month after the date on which you click on pay-&-submit for a selected PD Manager subscription plan.

We charge the fee associated with the member services you use to your credit card at the time (or shortly after the time) they are used. You are able to use the PD Manager Solution services as soon as your payment has been processed.

If we terminate your membership, you are still liable to pay us any amounts due and payable at the time of the termination, including the late payment fee which continues to accrue.

(p) Refund Policy

SMS work Call-Out Packs: If you purchase an SMS work Call-Out Credit Pack from our site, the pack is only valid for the number of days as specified on our website page at the time of purchase. ResourceCall will not refund unused SMS work Call-Out Credit Packs or partially used SMS work Call-Out packs (either currently active or expired).

Room Hire Advertisements: If you purchase a room hire advertisement from our site, the ad is only valid for the number of days or months as specified on our website page and stated in our Terms & Conditions at the time of purchase.

PD Manager Solution: If you purchase a PD Manager subscription from our site, the subscription, and associated services and access to data, is valid only for the number of months as specified at the time of purchase. ResourceCall will not refund unused or partially used PD Manager subscriptions.

ResourceCall is not required to provide a refund or replacement if you change your mind after purchase on any of our charged services. ResourceCall will offer a full refund if:

  • You have a valid SMS Call-Out Credit Pack and there is a problem with the SMS work Call-Out process that means we are unable to deliver the services as outlined in our Terms & Conditions and on our website and we are unable to rectify the situation in a timely manner.
  • You have a valid room hire advertisement and there is a problem with the Room Hire Board process that means we are unable to deliver the services as outlined in our Terms & Conditions and on our website and we are unable to rectify the situation in a timely manner.

Please keep your receipt as proof of purchase.

15. Liability

While we work hard to ensure the privacy and integrity of the material posted or submitted by you or through your account, we are not responsible for material that may be unlawfully observed by another person while in transit over the internet or stored on our website or systems.

Furthermore, we are not liable to you for any loss, expense, damage or liability suffered or incurred by you through your membership with us. In particular, we are not liable for the following:

  • (a) you are not able to access our member services;
  • (b) you experience a fault or disruption in accessing our member services;
  • (c) there are inaccuracies, errors or mistakes in the material posted on, referred to or linked to our member services;
  • (d) you act on material posted on, referred to or linked to our member services;
  • (e) bugs, viruses, trojan horses or other harmful code or communications are transmitted to or through our member services by us or another person; or
  • (f) we terminate your membership.

If we are liable to you in negligence, contract breach or at common law, any express or implied conditions or warranties, including conditions or warranties implied by law, are excluded. If our liability is not excluded, our liability to you is limited to either (in our absolute discretion) the cost of repairing or resupplying the goods or services or paying to you the cost of repairing or resupplying the goods or services. Nothing in our member terms limits your rights under the Australian Consumer Law.

16. Issues and disputes

If you have an issue, we encourage you to contact us and we will try to resolve it in accordance with the laws of Victoria, Australia. If there is a dispute, you submit to the exclusive jurisdiction of the courts of Victoria, Australia or federal courts based in Victoria, Australia.

17. Terms

In our member terms, the following terms have the following meanings:

  • Resource: A registered member who submits a Profile and gains access to our Resource tools and/or who creates and manages a PD Log on our site
  • Search/ Search Result: A search for publicly available information on our site
  • IP: copyright, trademark, patent or other intellectual property right of a person
  • Employer: a member who registers with us as an employer and gains access to our Employer services including work Call-Out tools, Job posting services, Room Hire advertising and searching services, Professional Development course advertising and searching services, and our PD Manager Solution including accessing linked PD Logs
  • Work Call-Out: An SMS message that alerts selected Resource members to a defined work Call-Out brief from a registered Employer member. The SMS contains a link to the defined work Call-Out that can only be accessed by selected Resource members
  • Job Board: a dedicated section of our website available to registered members to post and respond to advertised Job Posts
  • Job Post: an advertisement for a job posted by a job advertiser on our website
  • Job Advertiser: a member who registers with us as a job advertiser and gains access to our job advertiser tools, including posting job posts
  • Job Searcher: a member who registers with us as a job searcher and gains access to our job searcher tools, including submitting applications
  • Room Hire Board: a dedicated section of our website available to registered members to post room hire ads and contact room hire advertisers
  • Room Hire Advertiser: a member who registers with us as a room hire advertiser and gains access to our room hire advertiser tools, including posting room hire ads
  • PD Shop: a dedicated section of our website available to the public and registered members to search for and advertise professional development courses in Australia
  • Professional Development Course Advertiser: a member who registers with us as a Professional Development Course advertiser and gains access to our PD Shop advertiser tools, including posting professional development course advertisement posts
  • Professional Development Course Searcher: a member of the public who searches our site or who registers with us as a member and accesses to our PD Shop searcher tools
  • Ad, Ads or Advertisement: an advertisement for either a job posted by a job advertiser, a room hire profile posted by a room hire advertiser, or a professional development course posted by a professional development course provider on our site
  • PD Manager Solution: our member service that allows Resource members to set up and manage their PD Log and Currency records and information. And allows Employer members to subscribe to an account to set up and manage their invited Resource members PD Logs and Currency records
  • PD Log: our template for recording a member’s professional development and currency information
  • Searcher: any individual, either registered or a member of the public who searches the publically available material on our website
  • Material: includes comments, messages, text, files, images, photos, video, sounds and other information
  • Member services: Submitting Profiles, posting jobs on our Job Board, posting room hire advertisements, posting professional development course advertisements, conducting searches, sending work Call-Out, using PD Manager solution and accessing and using other members only features of our website
  • Personal information: information which identifies you as an individual or from your identity can be reasonably ascertained
  • Privacy policy: the privacy policy posted on our website and which specifies the personal information we collect, how we use that personal information, to who we may disclose that personal information and your rights
